(1) Whether felony murder and robbery ought both to have been left to the jury at the Appellant’s trial. (2) Whether the trial judge’s directions to the jury regarding the identification evidence were sufficient.

Facts

On 31 July 2020 the Appellant, Mekeal Antoine, was found guilty by a jury of the murder of Brent Samuel. He was convicted on the basis of joint enterprise liability, together with three others who have never been charged, and whose identities are unknown. Following conviction, the Appellant was sentenced by the trial judge to the only available penalty for murder – death by hanging. His appeal to the Court of Appeal of Trinidad and Tobago was dismissed by a judgment delivered on 18 July 2024. The Appellant applies for permission to appeal from that judgment on two grounds. He is seeking an order quashing the Appellant’s conviction and directing a retrial.
