Issue
Did the courts below err in concluding that Sports Data Feed Ltd ("SDF") did not have an exclusive licence in UK football betting?
Facts
This appeal concerns the question of whether the appellant was an exclusive licensee such that it could enforce certain rights against the respondents. SDF, the appellant, is a Mauritian company whose primary business is to act as a licensee of the owners and administrators of official football data. SDF’s case is that it was the exclusive licensee of Football DataCo Limited (“FDC”), an English company, in respect of IP rights in (a) professional English and Scottish league fixture lists (the “Fixture Lists”) and (b) other statistics gathered live during matches such as goals, cards, substitutions etc. (the “Football Data”). Silver Sports, the first respondent, is a Mauritian company that operates as a bookmaker. It is licensed by the GRA, the gambling regulator and the second respondent, to conduct fixed odds betting on football matches outside Mauritius including football matches organised by the UK leagues (“UK Matches”). SDF brought proceedings against the respondents for infringement of copyright, seeking injunctive relief and damages against Silver Sports and declaratory relief from the GRA. The respondents contested whether SDF was in fact an exclusive licensee. At first instance, the Commercial Division of the Mauritius Supreme Court dismissed SDF’s case. The Court of Civil Appeal upheld the Commercial Division’s judgment. SDF now appeals to the Judicial Committee.
