Issue
Did the Court of Appeal err in finding that it would be disproportionate to enforce the confiscation order made against the Respondent in circumstances where his co-defendant had satisfied the confiscation order made against that co-defendant?
Facts
On 25 September 2023, Clayton Stanfield Greene (“CSG”) was convicted of concealing or disguising the proceeds of criminal conduct. CSG was found to have received funds from his co-defendant, Floyd Basil Hall (“FBH”), who was convicted of bribery. On 12 October 2023, confiscation orders were made against CSG and FBH. The first instance judge ordered that the sum of $943,295.70 be confiscated from FBH and the sum of $330,021 be confiscated from CSG. The Court of Appeal varied the confiscation orders so that the total sum of $1,181,528 was to be paid by FBH and the sum of $419,369 was to be paid by CSG. The Court of Appeal also ordered that “this order is not to be enforced against CSG to the extent that this sum has already been recovered by way of satisfaction of the confiscation order made against FBH.” The Appellant now appeals that part of the order to the JCPC.
