Did the Trial Judge give insufficient directions concerning witness credibility and confession evidence?
Facts
The Appellant was convicted of attempted murder on 31 January 2017 in respect of events that occurred in 2008. It appears that the jury determined that the Appellant had entered into an argument with the victim, Mr Smith, whilst the latter was walking with his god-sister. The argument escalated until the Appellant struck the victim with a bike and proceeded to strike him with a stone/block in the head. Mr Smith spent a year and a half in hospital and has lasting injuries. In October 2017, the Appellant was sentenced to 30 years in prison. The Appellant appealed to the Court of Appeal of the Commonwealth of the Bahamas challenging his conviction on the grounds that the original court had infringed his right to a fair trial and provided serious misdirections to the jury. In July 2020, the Court of Appeal dismissed his appeal on all grounds on the basis of lack of merit. The Appellant now appeals to the Judicial Committee of the Privy Council.
