Facts
Mr Molyneux pleaded guilty to drug trafficking offences. The basis of his plea was that he played a ‘pivotal role’ in an organised crime group responsible for importing large quantities of drugs from the UK into the Isle of Man. Mr Molyneux was subsequently sentenced to twenty years imprisonment. The Deemster (first instance judge) made a confiscation order under the Isle of Man’s Proceeds of Crime Act 2008 ordering Mr Molyneux to pay £65,011. This order was subsequently upheld on Appeal by the High Court of the Isle of Man. This appeal solely concerns that confiscation order. Mr Molyneux contends that he did not in fact profit at all from his role in international drug trafficking but was merely seeking to pay drug debts to other members of the organised crime group. The Deemster and the High Court both rejected this evidence as ‘thoroughly unconvincing’.
