Winston Finzi (Appellant) v Jamaican Redevelopment Foundation Inc. and others (Respondents) (Jamaica)
Case ID: JCPC 2020/0016
Jurisdiction: Court of Appeal of Jamaica
Case summary
Issue
Did the Court of Appeal of Jamaica wrongly decide that Mr Finzi had no real prospect of successfully appealing against the summary determination of his claim?
Facts
Mr Finzi alleges that Jamaica Redevelopment Foundation and two of its agents procured various court judgments against him through fraud. Mr Finzi filed a claim seeking a declaration to that effect. The Supreme Court of Jamaica granted summary judgment in favour of JRF and the agents on the basis that Mr Finzi’s claim was an abuse of process. The Court of Appeal refused Mr Finzi permission to appeal against that decision.
Mr Finzi now appeals to the JCPC.
