Facts

The respondent obtained a loan from the appellant bank for over $21m in July 2007. After she ceased making interest payments at the end of 2009, the bank issued proceedings to recover the money owed on the loan. The particulars of claim set out the terms of a promissory note signed by the respondent on 27 July 2007 in connection with the loan. In the defence the respondent alleged that her signature on this document was a forgery. The Bank applied successfully for summary judgment but this was overturned on appeal.
